By accessing or using Orato's AI voice agent platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Orato provides an AI-powered voice agent platform that enables businesses to:
- Conduct automated inbound and outbound voice conversations
- Qualify leads and schedule appointments
- Manage customer follow-ups and engagement
- Analyze call transcripts and generate insights
- Integrate with CRM systems and business tools
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
3A. Third-Party Sign-In (OAuth)
Orato supports account registration and login via third-party identity providers, including Google, Microsoft, and other OAuth-compatible services. By choosing to sign in through any such provider, you agree that:
- Your authentication is governed by the terms, policies, and security standards of the selected third-party provider. You are responsible for reviewing and complying with those policies.
- Orato relies on the provider's authentication infrastructure to verify your identity and secure your session. Orato is not responsible for the actions, availability, or security practices of third-party providers.
- Revoking Orato's access from your provider's account settings may result in loss of access to the Service.
- You must not use OAuth sign-in to circumvent account restrictions or share credentials across multiple users or organizations.
4. Responsible Use Policy
Orato is committed to responsible AI communication. You agree NOT to use the Service for:
- Spam or unsolicited marketing without proper consent
- Harassment, threats, or abusive communication
- Fraudulent, deceptive, or misleading activities
- Violations of any applicable laws or regulations (including TCPA, GDPR, etc.)
- Impersonation or misrepresentation of identity
- Calling numbers on Do-Not-Call registries without consent
Violation of this policy may result in immediate termination of your account.
5. Compliance Requirements
You are responsible for ensuring your use of Orato complies with all applicable laws, including:
- Telephone Consumer Protection Act (TCPA) in the United States
- General Data Protection Regulation (GDPR) in the European Union
- CAN-SPAM Act for marketing communications
- Local telecommunications regulations in your jurisdiction
- Industry-specific regulations (e.g., HIPAA for healthcare)
6. Call Recording and Data
Our Service records calls for quality assurance and compliance purposes. You acknowledge that:
- You are responsible for obtaining necessary consent for call recording
- Call recordings are stored securely and accessible to authorized users
- Transcripts and analytics are generated from recorded calls
- You must comply with call recording laws in all applicable jurisdictions
7. Billing, Payments, and Pricing
7.1 General Payment Terms
Certain features of the Service require payment. You agree to:
- Pay all applicable fees as described in your subscription plan
- Provide accurate billing information
- Authorize recurring charges if applicable
- Review and accept any price changes with reasonable notice
7.2 Wallet Credits and Currency
Wallet top-ups and credit purchases on the Orato platform are denominated and charged in United States Dollars (USD). For convenience, a local currency equivalent will be displayed alongside USD amounts within the platform interface; however, all actual charges, transactions, and credits are processed in USD. Most underlying AI model API usage rates are also denominated in USD, and any token-level costs are reflected accordingly.
7.3 Per-Minute Call Pricing and AI Model Selection
The per-minute cost of calls conducted through the Service is directly dependent on the AI model selected by you when configuring your agent(s). Different models carry different underlying API costs, which are passed through to your usage charges.
You acknowledge and agree that:
- Per-minute pricing is subject to external variability, as the underlying AI model providers may change their API pricing at any time and without prior notice to Orato.
- If per-minute pricing changes due to an upstream model provider's pricing adjustment, Orato will notify you via email, provided you have opted in to receive product updates and communications during sign-up or within your account settings.
- It is your responsibility to keep your notification preferences and email address accurate and up to date to receive such alerts.
7.4 Platform Fee
In addition to per-minute usage costs, Orato charges a platform fee as outlined in your chosen subscription plan. This platform fee is subject to change in response to market conditions, operational costs, and other business factors. Orato will provide reasonable advance notice of any changes to the platform fee via email and/or through an in-platform notification before such changes take effect.
7.5 New Model Availability
Orato continuously evaluates new AI models for integration into the platform. New models will be made available to users only after the Orato team has conducted sufficient internal testing to verify their feasibility, reliability, and performance for live calling operations. Availability timelines are at Orato's sole discretion and subject to change without notice.
8. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Orato and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of your data and content uploaded to the Service.
9. Limitation of Liability
To the maximum extent permitted by law, Orato shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
10. Termination
We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will immediately cease. You may export your data within 30 days of termination.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
